ONLINE TERMS

Please read these terms and conditions carefully before ordering any products from our store. You should understand that by ordering any of our products, you agree to be bound by these terms and conditions.

Our online store is an independent legal entity which sells Vestaform in our own name and for our own account. It is licensed by Vestaform SL. 

COLOUR & MATERIAL SAMPLES

 

Please note that depending on the screen settings of your computer screen the colours of the images might differ. For an exact colour match, we always recommend you to order a sample swatch from sales@vestaform.com

WHAT HAPPENS AFTER PLACING THE ORDER

 

After placing your order, you will receive an e-mail from us with a confirmation that we have received your order. This does not mean that your order has been accepted until we sen you an e-mail with a Dispatch Confirmation that confirms that your order has been dispatched.

This will relate only to those products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate Dispatch Confirmation.

If we take payment or part payment before the products are dispatched it will be refunded and the order cancelled if the products have not been dispatched four weeks after the estimated date for delivery contained in your confirmation of order.

DELIVERY 

 

We will contact you approximately 2-7 days prior to the delivery date to confirm the delivery and to set the delivery time. If the delivery cannot be carried out and a new delivery must be made due to lack of access to the delivery address, you will be charged with a new delivery fee.

The estimated date for delivery will be sent to you in the Dispatch Confirmation.

All orders must be checked upon reception. Please investigate your order upon delivery to ensure that the entire order has been delivered and is intact. If any freight damage has occurred you will need to inform us immediately

RISK AND TITLE

 

Vestaform is responsible for loss of or damage to your order until delivered to you. As soon as you receive the order, you are responsible for it.

Ownership of the products will only pass to you when we receive full payment, including delivery charges, of the order. Until then, Vestaform is the legal owner and we can recover the products from you.

CONSUMER RIGHTS

 

As a consumer, you will have the right to cancel an order at any time within seven working days, beginning on the day after you receive the products. This means that any complaints must be made known to Vestaform within 7 days of receipt of the products. Products that have been delivered may not be returned without prior approval from Vestaform. If approved you will receive a full refund of the price paid for the Products in accordance with our refunds policy.

To cancel an order, you must inform us in writing and return the products to us as soon as reasonably practicable, and at your own cost. You have a legal obligation to take reasonable care of the products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

Certain types of items cannot be returned, like custom products such as special orders or personalised items. Please get in touch if you have questions or concerns about your specific item. 

If you order a personalised or modified product, you will be notified by e-mail informing you that your order is a special order and that there is no right of cancellation after the delivery. If you wish to cancel your special order, this must be done within 24 hours of that email notification. 

The right of cancellation can only be made use of if the item is returned in its original condition. The right of cancellation lapses if you use the item in a way that reduces its sales value.

Should you unpack and assemble the item, the right of cancellation lapses. The packaging is a part of the order value. In order to exercise the right of cancellation an item must always be returned in the original packaging which must be in a saleable state.

Please note that Vestaform does not pick up return deliveries unless agreed otherwise.

PRICE AND PAYMENT

 

The price of the products and our delivery charges will be as stated on the site, except in cases of obvious error.

All products prices exclude VAT and delivery.

Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an order confirmation.

We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as an error.

OUR REFUNDS POLICY

If you return a product to us, we will examine the returned product and notify you if a refund is applicable. We will process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirm the right to a refund. We will refund the price of a defective product in full and any reasonable costs you incur in returning the item to us. 

We will refund any money received from you using the same method as originally used to pay for the order.

WRITTEN COMMUNICATIONS

Applicable laws require that some of the information or communications we send you should be in writing. When using our store, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

EVENTS OUTSIDE OUR CONTROL

Vestaform is not liable for any delay or failure to deliver or perform due to force majeure, strikes, lockouts or other labor difficulties, acts of war or terrorism, failure, or delay of sources of supply, transportation difficulties, accidents, fires, or any other causes of like or unlike nature beyond Vestaform’s control.

ENTIRE AGREEMENT

These terms and conditions and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of any Contract.

LAW AND JURISDICTION

Orders for the purchase of products through our store and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by Spanish law.
